Fred Pilkington BSc MA MRICS, Chartered Surveyor and RICS Registered Valuer, provides independent expert witness and expert determination services in connection with residential and commercial property valuation disputes.

Instructions are undertaken in accordance with the applicable RICS professional requirements and the relevant Civil Procedure Rules governing expert evidence.

Independent and Defensible Evidence

Reports are prepared to withstand scrutiny from the court, opposing counsel and instructing solicitors.

Conclusions are supported by clearly explained valuation methodology, relevant market analysis and robust, defensible comparable evidence.

Fred maintains strict independence throughout every instruction. When acting as an expert witness, his overriding responsibility is to assist the court or tribunal on matters within his expertise.

Single Joint and Party-Appointed Expert

Fred has acted as both a single joint expert and a party-appointed expert.

As a single joint expert, he may be instructed by two or more parties to provide independent valuation evidence for the court.

As a party-appointed expert, he may be instructed by one party while maintaining the independence and professional duties required of an expert witness.

Review of Expert Evidence

Where appropriate, Fred can review another expert’s report, examine its evidence and methodology, and identify important areas of agreement or disagreement.

Expert Determination

Fred accepts expert determination appointments where the parties have agreed to refer a property valuation issue to an independent expert.

The role is to consider the agreed question, available evidence and relevant valuation principles before providing an independent determination.

CPR Part 35 Reports

Where applicable, expert witness reports are prepared with regard to CPR Part 35, Practice Direction 35 and relevant RICS professional requirements.

Discussions Between Experts

Where required by the court or agreed by the parties, the instruction may involve a discussion between experts and the preparation of a joint statement setting out the areas of agreement and disagreement.

Diminution in Value Following Neighbouring Nuisance

Recent Instruction

Fred was recently instructed to provide independent expert valuation advice concerning the effect of nuisance from a neighbouring property on the value of a residential asset.

The assignment required consideration of the property, the nature of the alleged nuisance, relevant market evidence and the extent to which the circumstances affected market value.

The advice was supported by relevant and defensible comparable evidence.
